Membership Agreement

Membership Terms & Conditions.

Please review these membership terms before completing an online signup. These terms apply to Club16 Trevor Linden Fitness and She's FIT! facilities, services, amenities, and membership agreements where applicable.

Waiver of Liability

I agree that She's Fit, its officers, directors, employees, and agents will not be liable to me or any other person for damages arising from claims, demands, injuries, actions, or causes of action in respect of me or my property, including lost or damaged personal possessions, arising out of or connected with my use of services, facilities, activities, or my membership agreement.

This waiver includes claims arising from negligence and, where permitted by applicable law, gross negligence. I expressly waive, release, and discharge She's Fit, its officers, directors, employees, and agents from all such claims. If I use other facilities operating under the name Club16 Trevor Linden Fitness or She's FIT!, these terms, including this waiver, apply to my use of those facilities and benefit the owner, officers, directors, employees, and agents of those facilities.

I agree this waiver survives termination of this agreement and is a fundamental term of this agreement.

Acceptance of Risks

To the fullest extent permitted by applicable law, She's Fit does not assume responsibility for my use of the facilities or my participation in activities occurring within the facilities. Facilities are provided without warranties of any kind, express or implied, including warranties regarding fitness for a particular purpose or workmanlike quality.

I understand that use of the facilities and participation in activities can include inherently risky and hazardous activities. I use the facilities and participate at my own risk. I will not use facilities or engage in activities unless I am physically able to do so safely and without injury to myself or others. I acknowledge that She's Fit has not recommended, and will not recommend, any medical treatment.

Injuries

I recognize that as a participant I may experience injuries including sprains, strains, bruises, broken bones, concussion, paralysis, or death. I will immediately report any accident or injury suffered in the club facilities before leaving the premises, in writing, to a staff person, and will provide a written report from my doctor within a reasonable time.

Agreement Terms

Invalid Provisions

If any part of this agreement is found to be invalid or unenforceable, the remainder of the agreement will remain in full force and effect.

Entire Agreement

This document incorporates the entire agreement between me and the club. No modification will be effective unless made in writing and signed by each of us. There are no representations, warranties, terms, conditions, undertakings, or collateral agreements, express, implied, or statutory, except as specified in this document.

Non-Waiver

No waiver of any provision in this agreement constitutes a waiver of any other provision, and no waiver constitutes a continuing waiver.

Assignment

The club may assign this agreement. Provided the assignee agrees to assume the obligations of the club, the club will be relieved of those obligations upon notice to me. I understand I may not assign my membership to another person.

Co-Signer

If the member is under 19 years of age on the date this agreement is signed, a co-signer is required. The co-signer promises to pay all amounts due to the club under this agreement when due and to keep and perform all member promises and agreements. The co-signer is a primary debtor to the same extent as if the co-signer signed as a member and is not merely a guarantor or surety.

Payments, Fees & Default

Default or Early Termination by the Club

If I default on any payment due under this agreement, the club may declare all or any future payments immediately payable. If I breach this agreement, She's Fit may suspend or terminate my membership in its sole discretion.

Fee Adjustments

I agree that membership fees may increase from time to time, including after the expiration of a minimum membership term or during a no term membership, unless I paid the applicable Price For Life membership insurance payment. The club may introduce new facilities or programs available for an additional fee.

Service Charges

I agree to pay a $20.00 plus applicable tax service charge for all rejected payments, whether by pre-authorized or credit card auto debit system, Visa, MasterCard, cheque, or otherwise. The club may re-negotiate any returned item, including service charges, through the pre-authorized payment system.

Membership Cards & Photos

I agree to have my picture taken for the club's computer file upon joining. Membership cards remain the property of the club at all times. I agree to return my membership card at the end of my membership. I will pay a $20.00 plus applicable tax fee for each replacement card required. I must present my membership card on every visit and, if lost or stolen, must purchase another to gain entry.

Membership Privileges

  • Regular membership privileges include use of the selected club location only.
  • Elite Plus membership privileges include use of all club locations, tanning, hydromassage, and out-of-town guests.
  • VIP membership privileges include use of all club locations, tanning, hydromassage, infrared sauna, red light therapy, and out-of-town guests.

Guest Privileges

Elite Plus and VIP members may bring out-of-town guests, defined as guests living outside the Lower Mainland of Vancouver and the Fraser Valley, at no additional charge. The guest must provide identification showing their out-of-town residential address and complete the standard waiver. The same guest may only use She's FIT! and Club16 facilities for up to 7 days per month. Other guests must pay the standard drop-in fee, currently $20.00 per day visit.

I agree that I will ensure my guests comply with club policies and I will be responsible for reimbursing the club for damage, harm, loss, or expenses caused by my guest's failure to comply.

Temporary or Permanent Closure

She's Fit may temporarily close facilities to repair damage caused by fire or other causes, or for renovations. The club may provide access to a fitness facility within 30 km of the closed location or extend the membership by the length of the closure. If facilities permanently close, the club may provide a membership in a fitness facility within 30 km of my location, and my membership will continue at the new location on the same terms.

Third Party Promotions

She's Fit may secure promotions or deals from third-party businesses and make them available by virtue of membership. The club does not guarantee availability of third-party promotions and may change, replace, terminate, or revise those promotions at any time without notice or compensation.

Member Termination

No Term Membership

For this agreement to be fulfilled, the agreement anniversary date must have passed and 30 days' notice of cancellation must be given. All scheduled payments within the 30-day notice period, including dues and club enhancement fee, will be billed as scheduled.

Minimum Membership Term

If I have a minimum membership term, I may terminate after expiration of the minimum membership term with 30 days' notice by calling ABC Fitness at 1-888-827-9262 or emailing [email protected]. I acknowledge I am responsible for paying any outstanding balance to keep my account in good standing.

If the membership is not terminated after the anniversary date of the minimum membership term, it continues as a no term membership. To terminate before the anniversary date, 30 days' notice must be provided and a cancellation fee of $75.00 plus applicable taxes must be paid. All scheduled payments within the 30-day notice period, including dues and club enhancement fee, will be billed as scheduled.

Notices

All notices, requests, demands, directions, and other communications provided for in this agreement shall be deemed given, delivered, or made if in writing and either delivered or sent by registered mail, fax, or electronic mail to the applicable party at the address shown in this agreement, or at another address a party may notify another in accordance with this provision.

Club Policies

She's Fit may publish and amend policies and regulations for facilities and use of facilities, including changing hours of operation. Continued membership is conditional on compliance with the policies, including:

  • A towel is required on the club floor at all times and equipment must be cleaned after use.
  • Appropriate clothing and footwear are required within the facility at all times.
  • I will only use facilities and equipment if I know how to use them safely without injury to myself, others, or the premises.
  • All fitness equipment must be returned to its appropriate space, including re-racking and putting away weights, plates, bars, and dumbbells. Dumbbells must not be dropped.
  • I will pay for costs of repairing equipment or premises if damaged because of my negligence or misconduct.
  • Gym bags are not allowed on the fitness or exercise floor.
  • Chalk is not allowed on the fitness or exercise floor.
  • Inappropriate, foul, lewd, or disrespectful language or behavior is not permitted.
  • I understand facilities may be busier at some times than others and I am not guaranteed use of specific equipment at specific times.

Recovery Services

Hydromassage

Anyone suffering from conditions upon which heat or massage may have an adverse effect should receive physician approval before use. This includes heat or circulatory problems, inflammatory conditions, varicose veins or thrombosis, swollen joints, acute inflammations, severe bruising, skin infections, contagious diseases, high temperature, or pain radiating to the arms or legs when the back is massaged.

Tanning

Precautions are necessary for safe tanning. I agree to comply with all instructions for use of the tanning system. I understand I am using these services at my own risk and confirm I will protect my vision by using provided goggles. I acknowledge certain medications, cosmetics, and skincare products may increase skin sensitivity to UV exposure, potentially causing burns, skin irritation, or other adverse effects. Risks of tanning include sunburn, premature skin damage or aging, and skin diseases including melanoma and other forms of skin cancer.

Beauty Angel Red Light Therapy

Protective eye goggles must be worn. This device offers a Vibra-Shape platform that some people may find strenuous, uncomfortable, or disorienting, and may cause lightheadedness. Treatment should stop immediately if any of these symptoms occur. Certain medications and cosmetics may increase sensitivity to light.

Cocoon Deluxe Pod & Red-Light Therapy

I understand that before undertaking sauna heat or vibratory massage treatments, I should consider my health and any medical conditions. The cocoon is not a medical device and is not intended to diagnose, treat, cure, or prevent disease. These services are offered for relaxation, general wellness, and fitness and are not substitutes for medical examinations or treatments. If I have a medical condition, I must make staff aware.

Contact Consent

Member affirms that the mailing address, telephone number, cellular telephone number, and email address provided are accurate and were provided voluntarily. Subject to applicable law, Member agrees that She's Fit and ABC Global Services, including agents, affiliates, vendors, debt collection agencies, or attorneys, may contact Member at any provided mailing address, telephone number, cellular telephone number, or email address, including via SMS, automated dialing system, or prerecorded voice messages.

Member acknowledges this consent is not required as a condition of purchasing goods or services and that all contact information provided is accurate. If Member replies STOP to opt out of text alerts, the opt out applies to text alerts only.

E-Sign Consent

Certain laws and regulations may require the club or service provider to provide notices and disclosures on paper. With Member's consent, this information may be provided electronically. Member's consent applies to disclosures, notices, agreements, statements, terms and conditions, and any other information the club or service provider may provide.

Consent to receive documents electronically continues until withdrawn. Member may request a paper copy of electronic documents by contacting the club or service provider. Member may withdraw consent at any time by notifying customer service. Withdrawing consent may result in additional fees for receipt of documents.

Member agrees to maintain a valid email address and promptly notify the club or service provider of changes. To access, view, and receive documents electronically, Member must have a computer, mobile device, tablet, or smartphone; supported browser software; internet connection; software capable of reading PDF files; an operating system capable of supporting those items; and a printer or storage device if Member wants to print or save documents.

By accepting these terms, Member agrees to the electronic document terms and confirms Member has the software, hardware, and active email address required to access, view, and receive documents electronically.
